TERMS OF SERVICE / LICENSE AGREEMENT
3dProp.store
This document is a license agreement between the user and the owner of 3dProp.store, Pixoloid Studios Ltd. (Registered under No.13-09-177042, Seat: 2092 Budakeszi, Dózsa György tér 1.)
Use of the content on our website is conditional upon the terms and conditions of purchase as set out below.
I. LICENSES
3dProp.store offers 3D Digital models, 3D scans („Content”) for concept and pre-production artists, game developers, special effects artists, graphic designers and other professionals. („User”)
Subject to payment of applicable fees and compliance with this Agreement 3dProp.store grants to User royalty free, non-exclusive, non-transferable worldwide license to use and modify the Content to develop and create audio-visual content for commercial and non-commercial purposes.
The Content may be strictly used as permitted by the type of license purchased by User as follows:
1. Personal License Terms
By buying the Personal License the Content may not be hosted on any company server, it is for individual use only. The use of the Content under the Personal License shall not exceed more than one (1) individual user, nor shall be used by any individual on behalf of any studio, company or entity. The Content can be forwarded or assigned by a freelance subcontractor to commercial studios or any other entities solely as part of a visual design.
2. Indie License Terms
By purchasing under the Indie License, the Content may be hosted on a company’s server. Under the Indie License, the Content may be purchased only by studios with a maximum seven (7) Artists, in total, including both employees and independent contractors. Use by studios with more than seven (7) artists under the Personal and/or Indie license shall constitute a violation of this License Agreement.
3. Studio License Terms
By purchasing under the Studio License, the Content may be hosted on a company’s server. Under the Studio License, the Content may be purchased by studios with eight (8), but with no more than forty (40) Artists, in total, including both employees and independent contractors.
Use by studios with forty (40) or more artists under either the Personal, Indie license and/or Studio license shall constitute a violation of this License Agreement.
4. Enterprise License Terms
If your use of the Content will include hosting on your company server and/or your studio includes forty (40) or more Artists, in total, including both employees and independent contractors, please contact info@3dprop.store for a special quote for an Enterprise License.
Use by studios with forty (40) or more artists under either the Personal, Indie license and/or Studio License shall constitute a violation of this License Agreement.
5. Restrictions:
It is not in any cases permitted to:
- Sell, share or distribute any of the Content modified or not by itself,
- Reselling or redistributing the 3D Scans or models at 'print on demand' services;
- Use the Content to directly create any type of physical products including but not limited to 3D prints, merchandise, toys and physical props or assets;
- Use a special program (spider, leecher) or script to automatically download all 3D models or scans on the 3dProp.store website.;
- Interfere with the security or otherwise abuse, disrupt, place excessive loads on, or attempt to gain unauthorized access to the 3dProp.store website or any system resources or networks connected to this website.
- Release the 3D models or scans or derivative products under Open Source Licenses
- Use the Content for illegal, obscene, fraudelent, pornographic, infringing or immoral materials
- Use the Content to create Non Fungible Tokens (NFT) or any other type of blockchai based products
II. PAYMENT
For the use of our services you shall be charged a compensation.
All prices are stated in USD without VAT. Payment can be made by credit card by Paypal or SimplePay.
Based on EU regulations we have to add the current applicable local VAT (27%) on all purchases made by individuals. A valid business entity name (company name or the name of you are doing business under as freelancer) and your local tax number or EU Tax ID in case of companies inside the EU (or EIN number in case of US companies) is required to deduct VAT from your purchase. This information can be added to your personal account or during checkout in the appropriate text boxes marked.
We issue electronic invoices only about all payments, what are sent out after the completion of each purchase and also downloadable under each user’s personal account.
Our invoices meet all criteria of the regulations of the EU and based on the EU directives of e-invoicing. They are fully legal documents, which can be used for tax purposes without printing. With making your payment, you agree with the use of these invoices.
III. PRIVACY
3dProp.store respects the privacy of the personal information of the individuals with whom we interact.
3dProp.store treats the personal data confidentiality, does not disclose personal information on the buyers on our website. No newsletters or offers will be sent to you without your prior consent. Any information submitted by the buyer will be used solely for the purpose of completing the transaction, delivering the product and addressing any customer service issues.

IV. INTELLECTUAL PROPERTY
All materials including the organization and presentation of these materials on our website are the property of 3dProd.store and are protected by intellectual property laws.
V. LIMITATION OF LIABILITY
You assume all responsibility and risk for the use of the 3dProp.store website, the 3d models, scans, materials and information.
3dProp.store does not represent or warrant that the site or any content available for downloading through the site will be free of viruses or similar contaminations of destructive features.
In no event shall 3dProp.store or any of its employees or contributors be liable for any incidental, indirect, punitive, exemplary or consequential damages whatsoever, including damages for loss of profits, interruption, loss of business information, loss of data, or any other pecuniary loss in connection with any claim, loss, action, suit, damage or other proceeding arising under or out of this License, including without limitation your use of, reliance upon, access to or exploitation of the 3dProp.store website, the materials or any part thereof, or any rights granted to you hereunder, even if we have been advised of the possibility of such damaged, whether the action is based on contract, tort (including negligence), infringement of intellectual property rights or otherwise.
VI. INDEMNIFICATION
You agree to indemnify and hold 3dProp.store harmless against all claims or liability asserted against 3dProp.store arising out of or in connection with any breach by you or anyone acting on your behalf of any of this License
VII. MODIFICATION
3dProp.store reserves the right to make any changes it deems appropriate in this Agreement as well as any prices at any time without prior notice.
If we identify a fault or error in already purchased assets or files, those will be removed from the user’s download library. In this case we will contact all buyers of the actual assets to replace the faulty assets free of charge.
VIII. TERMINATION RIGHT
3dProp.store reserves the right to terminate the license for the use of the Content on 3dProp.store if the User is found in breach of this License and does not remedy that breach within three (3) days of receiving notice from 3dProp.store.
IX. WITHDRAWAL RIGHT
User may withdraw from the purchase only in case the user has paid the purchase price but has not downloaded the Content. The withdrawal right can be exercised in 14 (Fourteen) days as of the payment of purchase price. In case of withdrawal we refund the payment and delete the content from the user’s account in 7 (seven) days as of informing us on your withdrawal at following channels:

X. MISCELLANEOUS
This Agreement shall be governed by and construed in accordance with the laws of Hungary, without regards to conflict of laws provisions thereto. The parties consent to the exclusive jurisdiction of the courts in Hungary.
In case any part of this Agreement is declared legally invalid, this shall not affect the validity of the whole of the agreement. In such cases the parties agree on one or more replacement provisions that approximate the original intent of the invalid provisions within the limits of the law.
Pixoloid Studios is entitled to transfer its rights and obligations under this agreement to a third party as part of an acquisition of 3dProp.store or the associated business activities.
